The five-judge constitution seat of Supreme Court, driven by Chief Justice Dipak Misra, struck down Section 57 of the Aadhaar Act which permitted the legislature as well as any private entity or company to request for Aadhaar.

As per the latest news, Section 57 of the Aadhaar Act now allows any government, private entity, or person to ask for Aadhaar.

Here is the detailed information regarding where Aadhaar will not be mandatory anymore.

Bank Account

According to the Supreme Court, you no longer need to submit your Aadhaar card to open a bank account. Of late all of us have received tons of messages from our banks asking us to update our Aadhaar number on their site or by visiting the branch personally. But, the verdict has ruled out banks asking for Aadhaar from any of its customers.

While buying a new SIM card

As per the latest rule, no private companies can ask you for your Aadhaar card to buy a new SIM card. Earlier, Telecom operators were asked to do verify each number with customer’s Aadhaar details.

Appearing for school admissions and in any competitive exams

The new rule has given a big relief to all the students who wish to appear for competitive examinations like University Grant Commission, National Eligibility cum Entrance Test, and Central Board of Secondary Exams. Students will no longer have to register for these exams with their Aadhaar details.

Where Aadhaar is mandatory?

Pan Card

Almost everyone must have linked their Aadhaar number with their Pan card and the rule remains the same. It is mandatory under section 139AA of the IT Act.

While filing an Income Tax return

While filing an Income Tax Return, it will still be mandatory to link your Aadhaar details.

Welfare schemes

Aadhaar keeps on being obligatory for profiting benefits under different government-run social welfare plans and endowments. Justice Bhushan said the Central government had given adequate justifications to maintain the Section 7 of Aadhaar Act, which manages concede of endowments and welfare benefits.
